End-User License Agreement (Web & iOS)
1. Acceptance of Terms
By accessing or using PathFinder ("Service"), whether through pathfinder.app ("Website") or the PathFinder iOS application ("App"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy.
If you do not agree to these Terms, you must immediately cease using the Service. These Terms constitute a legally binding agreement between you ("User") and ZIYON SAS, a French simplified joint-stock company (société par actions simplifiée) with registered offices in France ("Company", "we", "us", "our").
You must be at least 16 years old to use the Service. By using the Service, you represent that you meet this age requirement.
2. Description of Service
PathFinder is an AI-powered career guidance platform that helps users discover career paths, assess their skills and personality using psychometric models (RIASEC, OCEAN/Big-5), and receive personalised career roadmaps and learning resources.
- Psychometric assessments and personality profiling (RIASEC, OCEAN)
- AI-generated career pathway recommendations
- ROI analysis comparing education costs against salary projections
- Curated learning resources and skill gap analysis
- Integration with public datasets (ESCO, ROME, national salary registers)
- Premium subscription features including detailed roadmaps and salary simulations
3. User Accounts & Eligibility
To access most features, you must create an account using a valid email address or through Apple/Google OAuth. You are responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account.
You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate. We reserve the right to suspend or terminate accounts that provide false information.
4. License to Use the Service (Web EULA)
Subject to these Terms, the Company grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Website and its content solely for your personal, non-commercial use.
- You may not copy, modify, distribute, sell, or lease any part of the Service.
- You may not reverse-engineer or attempt to extract source code.
- You may not use automated means (bots, scrapers) to access the Service.
- You may not resell or sublicense access to the Service.
- This licence terminates automatically if you breach these Terms.
5. End-User License Agreement — iOS App
The PathFinder iOS application is licensed, not sold, to you. This licence is subject to these Terms and the Apple Media Services Terms and Conditions.
5.1 Scope of Licence
The Company grants you a non-transferable licence to use the App on any Apple-branded devices that you own or control, as permitted by the App Store usage rules in the Apple Media Services Terms and Conditions.
5.2 Maintenance and Support
The Company is solely responsible for providing maintenance and support services for the App. Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.
5.3 Warranty
In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App.
5.4 Product Claims
The Company, not Apple, is responsible for addressing any claims relating to the App or your use of the App, including but not limited to: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection or similar legislation.
5.5 Third-Party Beneficiary
Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
5.6 Intellectual Property Infringement
In the event of any third-party claim that the App or your possession and use of the App infringes that third-party's intellectual property rights, the Company, not Apple, will be solely responsible for the investigation, defence, settlement and discharge of any such intellectual property infringement claim.
6. Subscriptions, Payments & Refunds
6.1 Free & Premium Tiers
PathFinder offers a free tier with limited features and a premium subscription ("PathFinder Pro") with full access to career pathways, AI insights, salary simulations, and action plans.
6.2 Billing
Premium subscriptions are billed on a monthly or annual basis via Stripe (Web) or Apple In-App Purchase (iOS). Prices are displayed in EUR or CHF depending on your region and are inclusive of applicable taxes.
Your subscription renews automatically at the end of each billing period unless cancelled at least 24 hours before the renewal date.
6.3 Cancellation
You may cancel your subscription at any time from your account settings (Web) or through the App Store subscription management (iOS). Cancellation takes effect at the end of the current billing period; you will retain access to premium features until that date.
6.4 Refunds
Web subscriptions: We offer a 30-day money-back guarantee for first-time subscribers. To request a refund, contact us at support@pathfinder.app within 30 days of initial purchase.
iOS subscriptions: Refunds for purchases made through the App Store are governed by Apple's refund policy. Please contact Apple Support directly.
6.5 Price Changes
We reserve the right to change subscription prices. We will provide at least 30 days' notice of any price change via email. Continued use of the Service after the price change takes effect constitutes your acceptance of the new price.
7. Psychometric Data & AI-Generated Results
PathFinder processes your assessment responses to generate personality profiles and career recommendations. By using the assessment features, you explicitly consent to the processing of this psychometric data under GDPR Article 9(2)(a).
- Assessment results are indicative and not a substitute for professional career counselling.
- AI-generated career recommendations are based on statistical models and may not reflect individual circumstances.
- Salary estimates are statistical medians and may vary significantly by employer, region, and individual qualifications.
- PathFinder does not guarantee employment outcomes.
- We do not share your psychometric profile with third parties for marketing or advertising purposes.
8. Intellectual Property
The Service and its entire contents, features, and functionality — including but not limited to all text, graphics, logos, algorithms, and software — are owned by ZIYON SAS and are protected by French and international intellectual property laws.
You are granted no right or licence with respect to any trade marks or service marks of the Company.
User-generated content (such as career notes or custom roadmap edits) remains your property, but you grant us a worldwide, royalty-free licence to use such content to provide and improve the Service.
9. Acceptable Use Policy
You agree not to use the Service to:
- Violate any applicable law or regulation.
- Impersonate any person or entity.
- Transmit unsolicited commercial communications (spam).
- Interfere with or disrupt the integrity or performance of the Service.
- Attempt to gain unauthorised access to any portion of the Service.
- Use the Service for mass recruitment, data harvesting, or commercial profiling of third parties.
- Upload content that is defamatory, obscene, or infringes third-party rights.
10. Privacy & Data Protection
Your use of the Service is also governed by our Privacy Policy, which is incorporated by reference into these Terms. By using the Service, you consent to the data practices described in our Privacy Policy.
The Service is compliant with the General Data Protection Regulation (GDPR), the Swiss Federal Act on Data Protection (FADP/nDSG), and applicable consumer privacy laws.
11. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, THE COMPANY DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. The Company does not warrant the accuracy, completeness, or usefulness of any information provided through the Service.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE COMPANY, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.
Our total aggregate liability to you for any claim arising out of or relating to these Terms or the Service shall not exceed the greater of (i) the amounts you have paid to us in the twelve (12) months preceding the claim, or (ii) €50.
Some jurisdictions do not allow the exclusion of certain warranties or limitations on liability. In such jurisdictions, our liability is limited to the fullest extent permitted by law.
13. Governing Law & Jurisdiction
These Terms are governed by and construed in accordance with the laws of France, without regard to its conflict of law provisions.
For users based in Switzerland, mandatory provisions of Swiss law (including the Swiss Federal Act on Data Protection and Swiss consumer protection laws) apply in addition to these Terms.
Any dispute arising from or relating to these Terms that cannot be resolved through the dispute resolution process below shall be subject to the exclusive jurisdiction of the courts of Paris, France, except where mandatory consumer protection laws in your country of residence grant jurisdiction to local courts.
14. Dispute Resolution
In the event of any dispute, controversy, or claim arising out of or relating to these Terms or the Service, we encourage you first to contact us directly at support@pathfinder.app. We will make good-faith efforts to resolve the dispute within 30 days.
If we cannot resolve the dispute informally, and you are a consumer in the European Union, you may also use the European Commission's Online Dispute Resolution (ODR) platform at ec.europa.eu/consumers/odr.
Nothing in this clause limits your rights to bring claims before a court of competent jurisdiction where required by applicable law.
15. Changes to Terms
We reserve the right to modify these Terms at any time. We will provide at least 15 days' notice of material changes via email or a prominent notice within the Service. Your continued use of the Service after the effective date of the updated Terms constitutes your acceptance of the changes.
If you do not agree with the updated Terms, you must stop using the Service and may close your account at any time.
